RizzRater is an AI-powered SaaS platform that provides automated content analysis and rating services. The Service operates on a freemium model with both free and paid subscription tiers.

3.1 AI-Generated Content Disclaimer

IMPORTANT: All ratings, analyses, and feedback provided by the Service are generated by artificial intelligence and are for entertainment and informational purposes only.

• AI-generated content may contain errors, inaccuracies, or biases
• Results should not be considered professional advice of any kind
• We make no guarantees about the accuracy, reliability, or completeness of AI-generated content
• You should not rely solely on AI-generated ratings for important decisions

4. Subscription and Payment Terms

4.1 Free Tier

The free tier provides limited access to the Service with usage restrictions. We may modify or discontinue the free tier at any time with reasonable notice.

4.2 Paid Subscriptions

Paid subscriptions are billed on a recurring basis according to the plan you select. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.3 Cancellation and Refunds

In accordance with Estonian law and EU Directive 2011/83/EU on consumer rights:

• 14-Day Withdrawal Right: You have the right to withdraw from a subscription within 14 days of purchase without giving any reason. However, if you begin using the Service during this period, you acknowledge that you forfeit this right.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
• No Refunds for Partial Periods: We do not provide refunds for partial subscription periods, except as required by law.
• Payment Disputes: Any payment disputes must be raised within 30 days of the charge.

5. User Conduct and Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload content depicting minors or non-consenting individuals
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without explicit permission
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Remove, circumvent, or create or use workarounds to any technical limitations, restrictions, or security measures

6. User-Generated Content

6.1 Your Content

You retain all ownership rights to content you submit to the Service ("Your Content"). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display Your Content solely for the purpose of providing and improving the Service.

6.2 Content Responsibility

You are solely responsible for Your Content. You represent and warrant that:

• You own or have the necessary rights to submit Your Content
• Your Content does not violate any third-party rights
• Your Content complies with these Terms and applicable laws

6.3 Content Moderation

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

TO THE MAXIMUM EXTENT PERMITTED BY ESTONIAN AND EU LAW:

11. Term and Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at info@rizzrater.ee or using the account deletion feature in the Service.

11.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

• We are required to do so by law
• We decide to discontinue the Service (with reasonable notice)

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete Your Content from our servers, though some data may be retained as required by law or for legitimate business purposes.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kozip Apparel OÜ regarding the Service.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, or failures of internet or hosting services.
